ABOUT THIS POLICY

This Privacy Policy sets out the information that we collect, the reasons for which we collect that information, and how we may use and share that information for the FARFETCH Second Life Program (“FARFETCH Second Life”).

INFORMATION COLLECTED AND PURPOSES OF PROCESSING

When you interact with us, whether by using our Website, or communicating with us, we can collect the following information about you for the following purposes:

To decide to make an offer of purchase of the items back from you: we collect your name; email; phone number and address. The legal basis is the performance of a contract with you.

To provide you with customer support on FARFETCH Second Life: we collect your name; email; phone number, address and your contact history with us. The legal basis is the performance of a contract with you.

To send you FARFETCH Second Life newsletters: we collect your name and email address. The Legal basis is your consent.

To analyze FARFETCH Second Life’s usage and participation in the program: we collect Cookie and device identifiers, like the IP address. The legal basis is Legitimate Interests of FARFETCH to understand the audience of the users off the website and the effectiveness of FARFETCH Second Life.

To carry on research, analysis, enquiries and surveys on FARFETCH Second Life’s usage and participation in the program: we collect your name; address and email. The legal basis is our legitimate interests in running the business and improve the program and your experience.

WITH WHOM DO WE SHARE YOUR INFORMATION

We share your information with: (i) Tradelux General Trading LLC (“Tradelux”), based in the UAE. Tradelux is one of the partners we work with for FARFETCH Second Life and the company responsible for quoting and buying the products you intend to sell on Farfetch Second Life if you are located in the UAE, Kuwait or Saudi Arabia; and (ii) Luxclusif Baltic OU (“Luxclusif”), based in Estonia. Luxclusif is the second partner with whom we work with for FARFETCH Second Life and the company responsible for quoting and buying the products you intend to sell on Farfetch Second Life if you are located in the European Union, United Kingdom or Norway.

We can also share your personal information with the carriers that will collect your items.

TRANSFERS OF YOUR PERSONAL DATA

In order to grant your participation in FARFETCH Second Life, in accordance with the purposes set out above, we may transfer and store the personal data that we collect from you to a destination outside of the European Economic Area (“EEA”). When doing so, we rely on the Commission’s model contracts for the transfer of personal data to third countries (i.e. the standard contractual clauses);

We will retain the information you give us for the time needed until the purchase of your item is completed, without prejudice of keeping it for a longer period in order to comply with any legal requirements applicable to us.

For the purposes of sending our newsletter, we will retain your data until you no longer wish to receive the newsletter, by unsubscribing.

YOUR RIGHTS

You have certain rights in relation to the personal data we hold about you, which we detail below. Some of these only apply in certain circumstances as set out in more detail below. We also set out how to exercise those rights. Please note that we will require you to verify your identity before responding to any requests to exercise your rights. We must respond to a request by you to exercise those rights without undue delay and at least within one month (although this may be extended by a further two months in certain circumstances). Request erasure of your personal data. This enables you to ask us to delete or remove personal data where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your personal data where you have successfully exercised your right to object to processing (see below), where we may have processed your information unlawfully or where we are required to erase your personal data to comply with local law. Note, however, that we may not always be able to comply with your request of erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request.
