2.ABOUT THIS POLICY
This Privacy Policy sets out the information that we collect, the reasons for which we collect that information, and how we may use and share that information for our Farfetch Login service (the “FARFETCH LOGIN”), which allows you to Log In into our own or our partners’ websites and applications using the credentials of your Farfetch Account. Please access the website www.farfetch.com to consult the Terms & Conditions and the Privacy Policy of the Farfetch Marketplace.
3.PURPOSES OF PROCESSING
When you use the Farfetch Login, we can, when applicable to your specific Login, process the following information about you for the following purposes:
a) To permit your Log In: we will process your e-mail address and password to allow the Log In in our own or our partners’ websites and applications through the credentials of your Farfetch account. The legal basis is the contract.
b) To register through the Farfetch Login: we will process your name, e-mail address and password to allow the Log In in our own or our partners’ websites and applications through the credentials of your Farfetch account. The legal basis is the contract.
c) To allow our partners to get to know you: we can process your profile – name, e-mail address, phone number, date of birth, gender, shipping and billing address –, order history and wishlist to allow our partners to get to know you better. The Legal basis for is the contract.
d) General analysis regarding website usage: we collect Cookie ID’s; Country; IP address. The legal basis is Legitimate Interests of Farfetch to understand the audience of the users of the website.
4.WITH WHOM DO WE SHARE YOUR INFORMATION
To provide the Farfetch Login service, including to allow you to Log In into our own or our partners’ websites and applications through the credentials of your Farfetch Account, we will share your information – as above specified – with the partners you chose to use the Farfetch Login with. We also share your information with our IT/technology providers to support, maintain and provide our technology and IT infrastructure that we use to store the information in a secure environment. We permit these companies to use your personal information only to the extent necessary to provide us with their services and products; we do not allow these third parties to disclose or use your information for any other purposes.
5.TRANSFERS OF YOUR PERSONAL DATA
To provide you the Farfetch Login service, in accordance with the purposes set out above, we may transfer and store the personal information that we collect from you to a destination outside of the European Economic Area (“EEA”), mostly to the United States, either to one of our partners or to one of the third parties with which we work, as stated below: When transferring personal information outside the EEA, we will rely on the Commission’s model contracts for the transfer of personal data to third countries pursuant to Decision 2010/87/EU; an Adequacy Decision which states adequate level of protection for personal data under Commission Decision; or the EU-US Privacy, when transferring your information to the US.
6.COOKIES
The Farfetch Login service uses cookies. Cookies are small files that are stored on your browser to let you enjoy all Farfetch Login features and also to let Farfetch know how often you use the service, the country from which you access the service and how long you stay on the same. All the information processed in this regard is treated in an aggregated way and for statistical purposes only, and it does not allow Farfetch to identify a single individual. If you want to delete any cookies that are already on your computer, please refer to the help and support area on your Internet browser for instructions on how to locate the file or directory that stores cookies. Information on deleting or controlling cookies is available at www.AboutCookies.org. Please note that by deleting our cookies or disabling future cookies you may not be able to access certain areas or features of our Website. We reserve the right to amend this provision on the use of cookies at any time in order to adapt it to legislative or regulatory changes or instructions on this matter dictated by any Regulatory Body or due to changes in the applicable law.
7.SECURITY
We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal data on our instructions and they are subject to a duty of confidentiality. We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.
8.RETENTION
We will retain your information or as long as you have your account with us and thereafter for such period as you may have questions or a claim in relation to our services, notwithstanding any superior retention period that we may be obliged to observe in accordance with legal requirements applicable to us. If you delete your Farfetch account, you will not be able to access our partners’ websites through your Farfetch credentials, since they are the same as your Customer Account.
9.YOUR RIGHTS
You have certain rights in relation to the personal data we hold about you, which we detail below. Some of these only apply in certain circumstances as set out in more detail below. We also set out how to exercise those rights. Please note that we will require you to verify your identity before responding to any requests to exercise your rights. We must respond to a request by you to exercise those rights without undue delay and at least within one month (although this may be extended by a further two months in certain circumstances). To exercise any of your rights, please contact privacy@farfetch.com.
a) Request access to your personal data (commonly known as a "data subject access request"). This enables you to receive a copy of the personal data we hold about you and to check that we are lawfully processing it.
b) Request correction of the personal data that we hold about you. This enables you to have any incomplete or inaccurate data we hold about you corrected, though we may need to verify the accuracy of the new data you provide to us.
c) Request erasure of your personal data. This enables you to ask us to delete or remove personal data where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your personal data where you have successfully exercised your right to object to processing (see below), where we may have processed your information unlawfully or where we are required to erase your personal data to comply with local law. Note, however, that we may not always be able to comply with your request of erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request. If you delete your Farfetch account, you will not be able to access our partners’ websites through your Farfetch credentials, since they are the same as your Customer Account.
d) Object to processing of your personal data where we are relying on a legitimate interest (or those of a third party) and there is something about your particular situation which makes you want to object to processing on this ground as you feel it impacts on your fundamental rights and freedoms. In some cases, we may demonstrate that we have compelling legitimate grounds to process your information which override your rights and freedoms.
e) Request restriction of processing of your personal data. This enables you to ask us to suspend the processing of your personal data in the following scenarios: (a) if you want us to establish the data's accuracy; (b) where our use of the data is unlawful but you do not want us to erase it; (c) where you need us to hold the data even if we no longer require it as you need it to establish, exercise or defend legal claims; or (d) you have objected to our use of your data but we need to verify whether we have overriding legitimate grounds to use it.
f) Request the transfer of your personal data to you or to a third party. We will provide to you, or a third party you have chosen, your personal data in a structured, commonly used, machine-readable format. Note that this right only applies to automated information which you initially provided consent for us to use or where we used the information to perform a contract with you.
g) Withdraw consent at any time where we are relying on consent to process your personal data. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide certain products or services to you. We will advise you if this is the case at the time you withdraw your consent.
